If a husband has filed for legal divorce in court and remains firm in his intention to separate but intentionally prevents his wife from obtaining a religious divorce, can the wife interpret the husband's legal filing as consent for a religious divorce? 1. If the legal divorce had the Islamic conditions of divorce then it is valid .
2. If the legal divorce had not the Islamic conditions of divorce then it is not valid then this woman can refer to a religious leader (Grand Ayatollah ) and ask him to do the divorce for her or to refer to an Islamic Court to do this for her.
