In the Name of God, the Most High

Khums is a part of the avenues of the Islamic ruler i.e. Imam and it has something to do with wilayah. When an Islamic government is in place, the recommended precaution is that khums should be given to a qualified Mujtahid (waliy-e faqih) or his representative. If those who have the right to receive and use khums e.g. the waliy-e faqih, his representative or other religious authorities allow someone to use it, it is permissible for him/ her to use khums; otherwise it is not permissible.
